Acceptance of Terms
By accessing or using DataSaaS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
You must be at least 18 years of age to use the Service. If you are using the Service on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Account Terms
You are responsible for maintaining the security of your account credentials. DataSaaS will not be liable for any loss or damage resulting from unauthorized access to your account.
- You must provide accurate and complete registration information.
- You are responsible for all activity that occurs under your account.
- One person or bot may not maintain more than one free account.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to refuse or cancel accounts used for spam, abuse, or any illegal activity.
Billing, Plans & Cancellation
Plans & pricing
DataSaaS offers two plan tiers — Starter and Growth — with pricing based on your monthly event volume. Current pricing is available at datasaas.com/pricing.
Free trial
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial.
Billing cycle
Plans are billed in advance on a monthly or annual basis. Annual plans receive a discount as shown on the pricing page. All fees are non-refundable except as stated below.
Cancellation
You may cancel your subscription at any time from your dashboard settings. Cancellation takes effect at the end of your current billing period — you will retain access until then. We do not offer prorated refunds for monthly plans. Annual plans may be refunded on a prorated basis if cancelled within the first 14 days.
Price changes
We will provide at least 30 days' notice via email before any pricing changes. Continued use of the Service after the change constitutes acceptance of the new pricing.
Usage Limits & Overages
Each plan includes a monthly event allowance ranging from 10,000 to 2,000,000 events. Events include pageviews, custom events, and any other data points tracked by the DataSaaS script.
- All connected websites are combined into a single monthly event total.
- If you exceed your plan's event limit, we will never drop your data. Tracking continues uninterrupted, but dashboard access may be restricted until you upgrade.
- We send a warning email when you reach 75% of your monthly limit.
- If you consistently exceed your limit for 3 or more consecutive months, we may require you to upgrade to an appropriate plan.
Your Responsibilities
When using DataSaaS, you agree to:
- Obtain necessary consent from your website visitors before deploying the DataSaaS tracking script, where required by applicable law (including GDPR, ePrivacy Directive, and CCPA).
- Comply with all applicable laws and regulations in your jurisdiction, including data protection and privacy laws.
- Not use the Service for illegal purposes, including tracking websites you do not own or operate.
- Not attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Not overload or disrupt the Service through excessive API requests, automated scraping, or denial-of-service attacks.
Data Ownership & Processing
You retain full ownership of your analytics data. DataSaaS acts as a data processor on your behalf — you are the data controller.
- We process your data solely to provide the analytics service described herein.
- We do not sell, share, rent, or use your data for advertising or any purpose other than operating the Service.
- Upon account deletion, all associated data is permanently and irreversibly deleted within 30 days.

Intellectual Property
DataSaaS and its licensors own all right, title, and interest in the Service, including the tracking script, dashboard, branding, and all associated intellectual property. These Terms do not grant you any rights to use DataSaaS trademarks or branding.
The tracking script is licensed for use solely on the domains you have registered within your DataSaaS account. You may not redistribute, resell, or sublicense the script.
Service Availability
We strive to maintain 99.9% uptime for the Service, but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible).
- Force majeure events (natural disasters, government actions, etc.).
- Third-party service outages (hosting providers, DNS, etc.).
DataSaaS is not liable for any damages resulting from service downtime or data loss caused by events beyond our reasonable control.
Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, DataSaaS's total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the total fees paid by you to DataSaaS in the 12 months preceding the claim.
In no event shall DataSaaS be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
Indemnification
You agree to indemnify, defend, and hold harmless DataSaaS, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any applicable law or the rights of a third party.
- The content of the websites you track using the Service.
Termination
Either party may terminate this agreement at any time. You may cancel your account from your dashboard settings.
We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees when due, or engage in abusive or illegal activity. Upon termination:
- Your access to the dashboard and API will be revoked immediately.
- All associated analytics data will be permanently deleted within 30 days.
- You may export your data before termination via the dashboard or API.
Changes to These Terms
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email to the address associated with your account.
Continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the updated Terms, you may cancel your account before the changes take effect.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be resolved exclusively in the courts of [Jurisdiction].
